Die sogenannte Negativliste im CETA-Abkommen
V o r b e m e r k u n g d e r F r a g e s t e l l e r
Bei dem CETA-Freihandelsabkommen zwischen der EU und Kanada „wird die
größtmögliche Handelsliberalisierung angestrebt“ (vgl. CETA-
Verhandlungsmandat vom 24. April 2009). In CETA wird der NAFTA-Ansatz einer
Negativliste übernommen. Das heißt, es wird ein allgemeines Liberalisierungsgebot
eingeführt. Alles, das nicht der Liberalisierung unterworfen werden soll, muss
explizit gelistet werden nach dem Prinzip „list it or lose it“. Diese Vorbehalte zu den
in den Kapiteln „Investment“ und „Cross-Border Trade in Services" festgelegten
Liberalisierungsverpflichtungen finden sich in den Annexen I und II des CETA-
Abkommens (Bezug ist jeweils der am 26. September 2014 in englischer Fassung
veröffentlichte Vertragstext goo.gl/cM4BE7).
Annex I enthält Vorbehalte, die sich aus aktuellen Regulierungsmaßnahmen
ergeben (Reservations for Existing Measures and Liberalisation Commitments).
Für Bereiche, die nur in Annex I eingetragen sind, dürfen zukünftig keine neuen
oder restriktiveren Maßnahmen eingeführt werden (Standstill- bzw.
Stillhalteklausel). Demnach sind dort zukünftige Maßnahmen unzulässig, die Zugang zu
Märkten begrenzen oder ausländische Dienstleister und Investoren
„diskriminieren“. Zukünftige Liberalisierungen einer Vertragspartei werden automatisch zu
geltenden CETA-Verpflichtungen, die später nicht mehr zurückgenommen
werden können (Ratchet- bzw. Sperrklinkenklausel). Annex II enthält
Beschränkungen für zukünftige Maßnahmen (Reservations for Future Measures) und soll
damit dem Gesetzgeber Handlungsspielräume eröffnen. Nur für die im Annex II
aufgeführten Bereiche wäre der Gesetzgeber weiter in der Lage, regulierend tätig
zu werden. Es ist allerdings zu befürchten, dass hier einige Lücken bestehen.
Gleichzeitig ist die Unübersichtlichkeit des Negativlisten-Ansatzes ein großer
Kritikpunkt.
V o r b e me r k u n g d e r B u n d e s r e g i e r u n g
Der Entwurf für ein Handelsabkommen zwischen der Europäischen Union und
Kanada (CETA) wurde von der Europäischen Kommission am 26. September
2014 unter der Adresse

tradoc_152806.pdf im Internet veröffentlicht. Darin sind für die EU und
Deutschland bestimmte völkerrechtliche Verpflichtungen für Maßnahmen im
Dienstleistungsbereich vorgesehen, die sich insbesondere aus den Bestimmungen auf den
S. 146 - 295 ergeben. Grundlage hierfür sind die Verpflichtungen, die die EU und
Deutschland bereits in dem seit 20 Jahren in Kraft befindlichen Allgemeinen
Abkommen über den Handel mit Dienstleistungen (GATS) im Rahmen der
Welthandelsorganisation übernommen haben und die auch gegenüber Kanada gelten.
Hinter diesen bestehenden Verpflichtungen auf multilateraler Ebene kann das
bilaterale Abkommen zwischen der EU und Kanada nicht zurückbleiben.
Die Frage der Listensystematik, mit der die EU in ihren Handelsabkommen
solche Verpflichtungen festlegt, ist rechtstechnischer Natur. Sie ist nicht
entscheidend für den Verpflichtungsgrad, den die EU und Deutschland mit dem
betreffenden Abkommen übernehmen. Entscheidend ist insofern, dass die EU und
Deutschland den Spielraum behalten, Maßnahmen zur Gestaltung und
Organisation der Daseinsvorsorge und zur Regulierung insbesondere in den Bereichen
Bildung, Gesundheit, Soziales, Umwelt (u. a. Wasser), Kultur und Medien aufrecht
zu erhalten und auch zukünftig zu ergreifen. Die Rücknahme von
Liberalisierungen, die innerstaatlich vorgenommen wurden, muss insofern möglich sein. Der
CETA-Entwurf stellt diesen Spielraum sicher.
1. Welche Dienstleistungen unterfallen nach der aktuellen Fassung des CETA-
Vertragstextes in der EU bzw. in Deutschland der vollständigen
Liberalisierung (bitte einzeln nach der UN-Wirtschaftszweigklassifikation ISIC
Rev. 3.1-Codes auflisten, unstats.un.org/unsd/publication/seriesm/seriesm_
4rev3_1e.pdf)?
Nach dem o. g. Entwurf zum CETA-Abkommen unterfällt keine Dienstleistung
der vollständigen Liberalisierung, weil eine vollständige Liberalisierung im Sinne
der Abwesenheit staatlicher Regulierung nicht Ziel und auch nicht Gegenstand
der Verpflichtungen des Abkommens ist.
2. Welche Dienstleistungen sind in der aktuellen Fassung des CETA-
Vertragstextes in der EU bzw. in Deutschland von den drei
Liberalisierungsverpflichtungen Marktzugang, Inländerbehandlung und Meistbegünstigung
sowohl hinsichtlich Investitionen als auch hinsichtlich grenzüberschreitenden
Dienstleistungen ausgenommen (bitte einzeln nach ISIC Rev. 3.1-Codes
auflisten)?
Der o. g. Entwurf zum CETA-Abkommen sieht Verpflichtungen zu
Marktzugang, Inländerbehandlung und Meistbegünstigung im Dienstleistungsbereich
nach Maßgabe der Bestimmungen auf S. 153 f., 156, 189, 190, 254 ff. vor.
Zulässig bleiben Maßnahmen der Vertragsparteien, die gem. den Regelungen auf
S. 146 f., 188 f. oder 251 f. von den jeweiligen Kapiteln ausgenommen sind oder
für die die EU und ihre Mitgliedstaaten gem. Annex I (S. 1200 ff.) oder Annex II
(S. 1497 ff.) einen entsprechenden Vorbehalt formuliert haben. Weil die
jeweiligen Verpflichtungen sektorspezifisch und teilweise gesondert für jeden EU-
Mitgliedstaat festgelegt werden, wird insofern für Deutschland auf die als Anlage
beigefügten Auszüge aus den Annexen der EU verwiesen.*

3. Haben die Regelungen in CETA Auswirkung auf die
Entscheidungsspielräume nationaler, regionaler und lokaler öffentlicher Stelle bei der Auswahl
eines Dienstleistungsanbieters, wenn
a) die Tätigkeit, nur durch juristische Personen des öffentlichen Rechts
wahrgenommen werden darf, und wenn
b) die Tätigkeit nur durch juristische Personen des öffentlichen Rechts
wahrgenommen werden darf, aber durch Public-Private-Partnership-
Konstruktionen bereits Unternehmen in (teilweise) privater Hand in die
Aufgabenwahrnehmung eingebunden werden?
Die Fragestellung ist unklar.
Sofern die Fallgestaltungen in Buchstabe a und b Tätigkeiten in Ausübung
hoheitlicher Gewalt betreffen, wird auf die Ausnahmeregelungen auf S. 147 und 188
des o. g. Entwurfs verwiesen. Sofern sie andere Tätigkeiten betreffen, wird auf
die Regelung zu „public utilities“ auf S. 1500 des o. g. Entwurfs verwiesen, die
es den EU-Mitgliedstaaten erlaubt, die Erbringung von Dienstleistungen der
Daseinsvorsorge jederzeit als staatliche Monopole oder durch die Verleihung
ausschließlicher Rechte an private Unternehmen zu organisieren.
Sofern die Fallgestaltung in Buchstabe b die Möglichkeit betrifft, ein privates
Unternehmen, das in die Aufgabenwahrnehmung eingebunden ist, wieder von
dieser zu entbinden, so stehen die Regelungen im o. g. Entwurf dieser
Möglichkeit nicht entgegen. Ebenso verhält es sich, wenn eine bestehende PPP-
Konstruktion in eine rein öffentlich-rechtliche Konstruktion umgewandelt werden soll.
Insofern hat der o. g. Entwurf keine Auswirkung auf die
Entscheidungsspielräume öffentlicher Stellen in Deutschland.
4. Welche Voraussetzungen ermöglichen die unterschiedliche Behandlung von
öffentlichen und privaten Dienstleistungsanbietern im Hinblick auf die in
CETA definierte Inländerbehandlung, und welche Rolle spielen dabei die
privat- oder öffentlich-rechtliche Unternehmensform, die Eigentumsstruktur
in öffentlicher und/oder privater Hand oder die jeweilige Tätigkeit?
Die Verpflichtungen zur Inländerbehandlung im o. g. Entwurf zielen auf die
Gleichbehandlung von ausländischen und inländischen Unternehmen ab, nicht
aber auf die Gleichbehandlung von öffentlichen und privaten
Dienstleistungsanbietern. Für eine unterschiedliche Behandlung von öffentlichen und privaten
Dienstleistungsanbietern statuieren sie insofern keine spezifischen
Voraussetzungen.
5. Inwieweit gilt die Inländerbehandlung in CETA für zukünftige – nicht in
Annex I und II gelistete – neue Dienstleistungen?
Nach dem „Understanding on New Services“ auf S. 195 des o. g. Entwurfs gilt
die Verpflichtung zur Inländerbehandlung nicht für sog. New Services, die nicht
in der Zentralen Gütersystematik CPC 1991 gelistet sind.
6. Inwiefern besteht bei nicht unter Vorbehalt gestellten Dienstleistungen unter
CETA noch ein rechtsklarer Ermessensspielraum der nationalen, regionalen
und lokalen Behörden in der Frage, wie Dienste von allgemeinem
wirtschaftlichem Interesse auf eine den Bedürfnissen der Nutzer so gut wie möglich
entsprechende Weise zur Verfügung zu stellen, in Auftrag zu geben und zu
organisieren sind (im Sinne des Protokolls Nr. 26 AEUV)?
CETA schränkt die Spielräume nationaler, regionaler und lokaler Behörden,
Dienste der Daseinsvorsorge nach ihren Bedürfnissen bereitzustellen und zu
organisieren, nicht ein. Auf die Vorbemerkung der Bundesregierung sowie die
Antwort zu Frage 3 wird verwiesen.
7. An welcher Stelle im CETA-Kapitel zur öffentlichen Beschaffung
(Kapitel 21) findet sich eine Ausnahme für Dienstleistungskonzessionen des
Wassersektors, wie sie nach starker Kritik in das reformierte EU-Richtlinienpaket
zum Vergabewesen aufgenommen wurde, und inwiefern wird diese
Ausnahme im Rahmen der Inländerbehandlung berücksichtigt?
Das Kapitel zur öffentlichen Beschaffung im o. g. Entwurf enthält keine
Verpflichtungen für die Vergabe von Dienstleistungskonzessionen, sondern nur für
die Vergabe von öffentlichen Aufträgen. Es bedarf deshalb keiner Ausnahme im
Wassersektor. Im Übrigen gehören Wasserversorgungsdienstleistungen auch
nicht zu den Dienstleistungen, deren Beschaffung vom Beschaffungskapitel
erfasst wird. Hinsichtlich der Verpflichtungen im Dienstleistungsbereich wird auf
die Regelung auf S. 1502 f. verwiesen.
8. Welche einzelnen Dienstleistungssektoren und -subsektoren erachtet die
Bundesregierung als zum geschützten Bereich der „Public Utilities“-Klausel
zugehörig (nach ISIC Rev. 3.1-Codes, bitte begründen)?
Der Begriff „public utilities“, wie er auf S. 1500 des o. g. Entwurfs verwendet
wird, ist nicht abschließend definiert. Der Begriff ist die im internationalen
Handelsrecht gebräuchliche englischsprachige Formulierung für den Bereich der
Daseinsvorsorge. Dieser Begriff wird u. a. in dem seit 1995 im Rahmen der
Welthandelsorganisation geltenden GATS-Abkommen verwendet. Die beispielhafte
Aufzählung in der Regelung gibt einen Überblick, welche Sektoren grundsätzlich
unter die „public utilities“-Klausel fallen können. Diese Aufzählung ist jedoch
nicht abschließend. Aufgrund der offenen Formulierung können auch weitere
Sektoren dazu gezählt werden.
9. Wie verhält sich die Bundesregierung dazu, dass der von der EU unter
Annex II aufgeführte „Public Utilities“-Vorbehalt sich nur auf „public
monopolies“ und „exclusive rights granted to private operators“ bezieht, während der
Großteil der öffentlichen Dienstleistungen weder als „öffentliches Monopol“
noch als „ausschließliches“ Recht privater Anbieter erbracht wird?
Wenn Private Aufgaben der Daseinsvorsorge neben öffentlichen Dienstleistern
oder neben anderen privaten Anbietern erbringen, so steht der o. g. Entwurf dem
nicht entgegen – die Regelung zu „public utilities“ gewährt aber die Möglichkeit,
jederzeit öffentliche Monopole einzurichten oder ausschließliche Rechte zu
gewähren. Die Regelung entspricht in ihrer Reichweite der Regelung zur
Daseinsvorsorge im GATS-Abkommen. Die Bundesregierung begrüßt, dass die seit
20 Jahren geltende Rechtslage fortgeschrieben und nicht verändert wird.
10. Ist in den vom „Public Utilities“-Vorbehalt geschützten Sektoren die
zukünftige Einrichtung von öffentlichen Monopolen und öffentlichen
Dienstleistungen uneingeschränkt auch dort erlaubt, wo bereits private Anbieter neben
öffentlichen Dienstleistern tätig sind?
Ja.
11. Wie verhält sich die Bundesregierung dazu, dass sich der von der EU unter
Annex II aufgeführte „Public Utilities“-Vorbehalt nur auf Marktzugang und
nicht auf die Inländerbehandlung, die Meistbegünstigung und die
Investitionsschutzstandards bezieht?
Auf die Vorbemerkung der Bundesregierung sowie die Antworten zu den
Fragen 8 und 9 wird verwiesen. Die Bestimmungen für Investitionsschutz auf S. 158
ff. finden unabhängig von den Regelungen auf S. 1200 ff. Anwendung. Sie
schützen ausländische Investoren nur gegen bestimmte staatliche Beeinträchtigungen
nach Vornahme ihrer Investition. Klagen ausländischer Investoren sind zudem
nur in klar definierten und eng begrenzten Fällen begründet: Ein Schiedsgericht
müsste zu dem Urteil gelangen, dass die staatliche Maßnahme willkürlich,
offensichtlich unverhältnismäßig oder diskriminierend ist.
12. Welche Anforderungen können sich daraus ergeben, dass sich der von der
EU unter Annex II aufgeführte „Public Utilities“-Vorbehalt nicht auf
„Performance Requirements“ sowie „Senior Management and Boards of
Directors“ bezieht?
Für in Deutschland geltende Regelungen, die die Gestaltung und Organisation der
Daseinsvorsorge auf kommunaler Ebene betreffen, ergeben sich daraus keine
Anforderungen. Die Regelung zu „public utilities“ entspricht in ihrer Reichweite der
Regelung zur Daseinsvorsorge im GATS-Abkommen.
13. Wie verhält sich die Bundesregierung dazu, dass sich der von der EU unter
Annex II aufgeführte „Public Utilities“-Vorbehalt nur auf Investitionen und
nicht auf den grenzüberschreitenden Dienstleistungshandel, etwa über das
Internet, bezieht?
Auf die Antwort zu Frage 9 wird verwiesen.
14. Wie konkret bringt sich die Bundesregierung ein, um die in Fragen 9, 11 und
13 angesprochenen Lücken zu schließen (bitte begründen)?
Auf die Antworten zu den Fragen 9, 11 und 13 wird verwiesen. Die
Bundesregierung sieht keine Schutzlücken.
15. Warum beschränkt sich die deutsche Ausnahme für das Abfallmanagement
auf Monopole und „exclusive service suppliers“, so dass im Wettbewerb
stehende öffentliche Entsorger, die weder ein Monopol darstellen noch
„exklusive“ Dienstleistungsanbieter sind, von diesem Vorbehalt ausgeschlossen
sind?
16. Warum bezieht sich auch die deutsche Ausnahme für das Abfallmanagement
inkl. Abwasserentsorgung nur auf den Marktzugang und nicht auf die
Inländerbehandlung, die Meistbegünstigung und die Investitionsschutzstandards?
17. Warum wurde überhaupt ein deutscher Vorbehalt für das Abfallmanagement
eingeführt, wo doch „environmental services“ ohnehin das
Abfallmanagement umfassen und „environmental services“ durch den „Public-Utilities“-
Vorbehalt geschützt werden?
Aufgrund des Sachzusammenhangs werden die Fragen 15 bis 17 gemeinsam
beantwortet.
Der Vorbehalt zu Abfallmanagement gibt das geltende Verpflichtungsniveau
nach dem GATS-Abkommen wieder und umfasst die Ausübung der Tätigkeit
durch Monopole oder private Anbieter, denen exklusive Rechte eingeräumt
wurden. Wenn öffentliche Dienstleister Aufgaben des Abfallmanagements neben
privaten Anbietern erbringen, so steht der o. g. Entwurf dem nicht entgegen. Es ist
richtig, dass die Regelung zu „public utilities“ auf S. 1500 auf den Bereich der
sog. „environmental services“ Bezug nimmt. Der ergänzende Vorbehalt für das
Abfallmanagement wurde aus Gründen der Klarstellung eingeführt, was in
internationalen Verhandlungen nicht unüblich ist. Zu Investitionsschutz vgl. Antwort
zu Frage 11.
18. Ist nach Einschätzung der Bundesregierung sichergestellt, dass bei dem von
der EU unter Annex II aufgeführten Vorbehalt für Bildungs-, Gesundheits-
und soziale Dienste Gebühren, die zwar staatlich verordnet, aber von
Leistungsempfängern zu zahlen sind, nicht als private Finanzierung betrachtet
werden und geschützt sind (bitte begründen)?
Die Fragestellung ist unklar. Die verschiedenen für die EU unter Annex II
aufgeführten Vorbehalte betreffen nicht die Möglichkeit, für bestimmte
Dienstleistungen in den Bereichen Bildung, Gesundheit oder für soziale Dienste Gebühren
oder Entgelte von den Leistungsempfängern zu erheben; der o. g. Entwurf zum
CETA-Abkommen steht dem nicht entgegen. Sofern die Frage auf die
Umschreibung „public funding or State support in any form“ abzielt, die in bestimmten
Vorbehalten der EU in Annex II verwendet wird, so dient diese der Abgrenzung
zwischen rein privat finanzierten Dienstleistungen und solchen, die in irgendeiner
Weise öffentlich gefördert werden und gibt insofern das Verpflichtungsniveau
des GATS wieder.
19. Wie ist sichergestellt, dass bei dem von der EU unter Annex II aufgeführten
Vorbehalt für Bildungs-, Gesundheits- und soziale Dienste, eine
Dienstleistung mit Mischfinanzierung aus öffentlichen und privaten Quellen als
öffentlich finanziert gilt (bitte begründen)?
Die Vorbehalte für Bildungs-, Gesundheits- und soziale Dienste in Annex II
gelten für alle Dienstleistungen, die öffentliche Förderung oder staatliche
Unterstützung jedweder Art erhalten und aus diesem Grund nicht als privat finanziert
betrachtet werden. Aus diesem Wortlaut ergibt sich, dass der Vorbehalt für
Dienstleistungen mit Mischfinanzierung gilt.
Es wird darauf hingewiesen, dass es darüber hinaus auch Vorbehalte für rein
privat finanzierte Dienstleistungen entsprechend GATS in diesen Bereichen gibt.
20. Ist nach Ansicht der Bundesregierung sichergestellt, dass die
Entgeltfinanzierung über die Sozialversicherung sowie die Leistungserbringung im
Rahmen des sozialrechtlichen Dreiecksverhältnisses unter den Begriff der
öffentlich finanzierten Dienstleistungen im Sinne des Abkommens fallen (bitte
begründen)?
Die Bundesregierung ist sich der besonderen Bedeutung der Sozialversicherung
als wesentliches Fundament für den Sozialstaat bewusst. Die Sozialversicherung
in Deutschland wird daher in ihrer Funktionsweise durch CETA oder andere
Handelsabkommen nicht beeinträchtigt werden. Handelsabkommen der EU werden
die Spielräume in Deutschland zur Organisation der Sozialversicherung,
unabhängig von ihrer konkreten Ausgestaltung, Trägerstruktur und Finanzierung nicht
einschränken.
Der o. g. Entwurf zeigt konkret, wie diese Absicherung umgesetzt werden kann:
Das dort auf S. 251 ff. vorgesehene Kapitel zu Finanzdienstleistungen nimmt in
Artikel 1, Ziffer 5 die fünf Säulen der gesetzlichen Sozialversicherung in
Deutschland als „statutory systems of social security“ von den Verpflichtungen
dieses Kapitels umfassend aus.
Die für die EU und ihre Mitgliedstaaten verankerten Vorbehalte in Annex II auf
S. 1510 und 1511 f. und der Vorbehalt für Deutschland in Annex I auf S. 1334 f.
machen deutlich, dass die Marktöffnungsverpflichtungen auch insofern nicht
gelten, als die Sozialversicherungssysteme den Zugang für Leistungserbringer zu
ihren Abrechnungssystemen bestimmten Bedingungen unterwerfen.
Die Erstattungsfähigkeit bzw. Leistungspflicht für eine Heilbehandlung im
System der gesetzlichen Krankenversicherung unterliegt allgemein geltenden und
nicht diskriminierenden Voraussetzungen des Fünften Buches Sozialgesetzbuch
und wird durch CETA oder andere Handelsabkommen nicht beeinflusst.
Auch die Rahmenbedingungen der sozialrechtlichen Leistungserbringung ändern
sich durch das o. g. Abkommen nicht, vgl. die Vorbehalte auf den Seiten 1511,
1574 und 1575 in Annex II zu sozialen Dienstleistungen. D. h. die Organisation
und Struktur der Leistungserbringung durch die Träger der Wohlfahrt ist nicht
berührt und wird nicht in Frage gestellt.
21. Wie wird sichergestellt, dass die zuweilen bestehende Privilegierung der
traditionellen, gemeinnützigen freien Träger bei der öffentlichen
Bezuschussung nicht über die CETA-Bestimmungen zum Investitionsschutz
(insbesondere den Investitionsschutzstandard „fair and equitable treatment“)
angegriffen werden kann?
Bestehende Maßnahmen, wie die öffentliche Bezuschussung gemeinnütziger
freier Träger, können nicht mit Investitionsschutzbestimmungen angegriffen
werden. Investitionsschutzbestimmungen schützen ausländische Investoren nur
gegen bestimmte staatliche Beeinträchtigungen nach Vornahme ihrer Investition.
Ein Investor kann über Investitionsschutzvorschriften keinen Marktzugang
einklagen. Dies gilt für alle geltenden deutschen Investitionsschutzverträge ebenso
wie für CETA und soll nach Auffassung der Bundesregierung und der EU auch
für alle anderen zukünftigen EU-Abkommen mit
Investitionsschutzbestimmungen einschließlich TTIP gelten. Ein Investor könnte daher auch keine Verletzung
der Investitionsschutzbestimmungen daraus ableiten, dass Träger der freien
Wohlfahrtspflege in einem Bereich tätig sind, in dem er investiert hat. Der
Investor findet diese Bedingungen beim Eintritt in den Markt und bei Vornahme der
Investition vor. Durch Investitionsschutzbestimmungen ist ein Investor im
Übrigen nur gegen diskriminierende oder willkürliche staatliche Maßnahmen in klar
definierten und eng begrenzten Fällen geschützt, die seine bestehende Investition
beeinträchtigen. Nach CETA kann ein Investor zudem auch nicht beanspruchen,
bei Subventionen mit inländischen Unternehmen gleichbehandelt zu werden.
22. Warum bezieht sich die deutsche Ausnahme zu Gesundheits- und sozialen
Dienstleistungen, die die Finanzierung der Sozialversicherung schützen soll,
nur auf Investitionen und nicht auf den grenzüberschreitenden
Dienstleistungshandel?
Die Bundesregierung verweist auf den EU-Vorbehalt auf S. 1509, der die
grenzüberschreitenden Dienstleistungen betrifft und auch für Deutschland gilt. Der
deutsche Vorbehalt zur Sozialversicherung stellt eine ergänzende Klarstellung
dar. Auf die Antwort zu Frage 20 wird verwiesen.
23. Teilt die Bundesregierung die Auffassung, dass dadurch über das Internet
angebotene Versicherungsprodukte ein Schlupfloch für internationale
Versicherungskonzerne mit kanadischen Niederlassungen darstellen können?
Nein. Auf die Antwort zu Frage 20 wird verwiesen.
24. Teilt die Bundesregierung die Forderung der Bundesarbeitsgemeinschaft der
Freien Wohlfahrtspflege (BAGFW; vgl. goo.gl/NucXVc), dass die
Investitionsschutzbestimmungen in TTIP kein einklagbares Recht auf Marktzugang
umfassen sollen (bitte begründen) - zumal laut CETA-Vertragstext eine
Investoren-Eigenschaft bereits dann vorliegen soll, wenn eine Investition noch
gar nicht getätigt wurde, sondern es ausreicht, wenn eine Investition nur
angestrebt wird („Investor means a party, a natural person or an enterprise of a
Party […] that seeks to make […] an investment in the territory of the other
Party.“, S. 150) ?
Der CETA-Vertragsentwurf und der EU-Entwurf für
Investitionsschutzbestimmungen in TTIP sehen Investitionsschutz nur für bereits getätigte Investitionen
vor.
25. Wie ist nach Ansicht der Bundesregierung sichergestellt, dass durch CETA
keine sozial-ökologische Reform des Beschaffungswesens, vor allem der
Vergabe- und Tariftreuegesetze der Bundesländer, behindert wird,
angesichts dessen, dass die klare Definition von Sozialstandards (vgl. z. B.
Artikel IX.6 „Technical Specifications and Tender Documentation“) fehlt?
Dies ist sichergestellt, weil das Abkommen insofern keine hindernden
Verpflichtungen enthält, sondern die Spielräume des EU-Vergaberechts spiegelt. Die
Zulässigkeit ökologischer Vergabekriterien wird zudem ausdrücklich klargestellt,
siehe Artikel III Absatz 2 Buchstabe b, S. 310. Arbeits- und Sozialstandards
können auch weiterhin Kriterien bei der Auftragsvergabe sein. Die Regelung in
CETA entspricht dem WTO-Beschaffungsübereinkommen GPA, an das die EU
gebunden ist, und sieht keine darüber hinausgehenden Verpflichtungen vor.
CETA gefährdet daher nicht den EU-Acquis zur Möglichkeit der Festlegung von
Vergabekriterien wie etwa der Tariftreue.
26. Wie verhält sich die Bundesregierung dazu, dass der Annex II-Vorbehalt der
EU zu Strom- und Gasübertragungssystemen nicht die kommunalen Strom-
und Gasnetze erfasst, die derzeit in vielen Städten rekommunalisiert werden?
27. Warum hat die Bundesregierung nicht wie etwa Belgien spezifische
Ausnahmen für die Energieverteilung aufgenommen, die auch die örtlichen Netze
einschließen?
28. Wie schützt die Bundesregierung die Rekommunalisierungsmöglichkeit von
Strom- und Gasnetzen?
Die Fragen 26 bis 28 werden aufgrund des Sachzusammenhanges gemeinsam
beantwortet.
Der o. g. Entwurf steht einer Rekommunalisierung von kommunalen Strom- und
Gasnetzen nicht entgegen.
Gemeinden in Deutschland müssen ihre öffentlichen Verkehrswege für die
Verlegung und den Betrieb von Leitungen zur unmittelbaren Versorgung von
Letztverbrauchern im Gemeindegebiet diskriminierungsfrei durch Vertrag zur
Verfügung stellen. CETA enthält keine Regelung, die diese Verpflichtung zum
Abschluss diskriminierungsfreier Wegenutzungsverträge nach wettbewerblichem
Verfahren i. S. d. § 46 EnWG erweitert oder einschränkt. CETA verhindert auch
nicht die Weiterentwicklung dieser nationalen Vorschrift.
29. Warum enthält die Verpflichtungsliste keinerlei Ausnahmen der EU oder
Deutschlands die Telekommunikation betreffend?
Die EU und Deutschland haben im Bereich der Telekommunikation bereits im
GATS weitgehende Marktöffnungsverpflichtungen übernommen. Der o. g.
Entwurf trägt den Verpflichtungen im Rahmen der WTO Rechnung.
30. Warum lässt die Bundesregierung eine Einschränkung des politischen
Handlungsspielraumes hinsichtlich Universaldienstverpflichtungen zu, indem der
aktuelle CETA-Text festschreibt, dass diese „nicht belastender als nötig“
sein dürfen (Artikel X.7.2 Universal Service), was einer nicht objektiv
überprüfbaren und daher nicht leistbaren Begründungspflicht entspricht?
Die Bestimmung zu Universaldienstleistungen stammt aus dem Jahr 1996 und ist
Teil eines Referenzpapiers des WTO-Rahmenwerks zu
Telekommunikationsdienstleistungen. Das Referenzpapier ist für die EU und ihre Mitgliedstaaten
verbindlich, da sie es als zusätzliche Verpflichtungen in einem GATS-Annex
aufgenommen haben.
31. Wie ist die EU-, Bundes-, Landes- und kommunale Gesetzgebung zur
Nutzung von Gewässern (u. a. Wasserrahmenrichtlinie, Wasserhaushaltsgesetz,
Wassergesetze der Länder, kommunale Satzungen) gegenüber den CETA-
Liberalisierungsverpflichtungen abgesichert, wo es im Sonderartikel X.08
auf Seite 14 in Absatz 3 über Rechte und Verpflichtungen bezüglich Wasser
heißt: „Where a Party permits the commercial use of a specific water source,
it shall do so in a manner consistent with the Agreement“, während die
Bezeichnungen „permit“, „commercial use“ und „a specific water source“ offen
gelassen sind, so dass weitreichende Auslegungen im Sinne von Investoren
denkbar sind?
Der fragliche Artikel X.08 stellt klar, dass CETA keine Partei verpflichtet, einem
Investor die kommerzielle Nutzung von Wasser zu erlauben und dass Wasser in
seinem natürlichen Zustand kein kommerzielles Gut darstellt. Die Parteien
müssen aber nach Artikel X.08 Absatz 1 die Verpflichtungen aus den Kapiteln zu
Nachhaltigkeit sowie zu Handel und Umwelt beachten, die u. a. festschreiben,
dass Regelungen zum Umweltschutz, einschließlich des Wasserrechts, nicht mit
dem Ziel der Handelserleichterung abgesenkt werden dürfen.
Der fragliche Artikel X.08 ist nicht Teil des Investitionskapitels und begründet
keine Schutzrechte von Investoren. Insofern kann Artikel X.08 aus dem
einleitenden Kapitel nicht durch Schiedsgerichte zugunsten von Investoren ausgelegt
werden.
Das bedeutet, dass Artikel X.08 und das CETA-Abkommen die Spielräume in der
EU und in Deutschland, die Entnahme von Wasser aus der Natur zu organisieren
und zu regulieren, ausdrücklich erhält.

Reservations for Existing Measures and Liberalisation Commitments
1. The Schedule of a Party sets out, under Articles X.14 (Investment - Reservations and
Exceptions), X-06 (Cross-Border Trade in Services ª Reservations), X-03 (International
Maritime Transport Services ª Non-Conforming Measures), and, for the EU, X.9 (Financial
Services ª Non-Conforming Measures), the reservations taken by that Party with respect to
existing measures of a Party that do not conform with obligations imposed by:
Articles X.6 (Investment - National Treatment), X-03 (Cross-Border Trade in Services - National
Treatment) or, for the EU, X.03 (Financial Services ª National Treatment);
Articles X.7 (Investment - Most-Favoured-Nation Treatment), X-04 (Cross-Border Trade in
Services - Most-Favoured-Nation Treatment) or, for the EU, X.04 (Financial Services ª Most-
Favoured-Nation Treatment);
Article X.4 (Investment - Market Access),X-05 (Cross-Border Trade in Services - Market

2. Each reservation sets out the following elements:

(a) Sector refers to the general sector in which the reservation is taken;
(b) Sub-Sector refers to the specific sector in which the reservation is taken;
(c) Industry Classification refers, where applicable, to the activity covered by the
reservation according to CPC codes, ISIC codes, SIC codes, or as expressly otherwise
described in a Party¯s reservation?
(d) Type of Reservation specifies the obligation referred to in paragraph 1 for which a
reservation is taken;
(e) Level of Government indicates the level of government maintaining the measure for
which a reservation is taken;
(f) Measures identifies the laws, regulations or other measures, as qualified, where
indicated, by the Description element, for which the reservation is taken. A measure cited
in the Measures element:
(i) means the measure as amended, continued or renewed as of the date of entry
into force of this Agreement, and
(ii) includes any subordinate measure adopted or maintained under the authority
of and consistent with the measure; and
(iii) includes:
c) for EU Directives, any laws, regulations or other measures which
implement the Directive at Member State level;
d) for Canada, any laws, regulations or other measures at the national or
subnational level that implement agreements between the federal government
and provinces and territories.
(g) Description sets out the non-conforming aspects of the existing measure for which
the reservation is taken. It may also set out commitments for liberalization.
(h) Phase-Out sets out commitments, if any, for liberalisation after the date of entry into
force of this Agreement.
3. In the interpretation of a reservation, all elements of the reservation [are][shall be]
considered. A reservation [is][shall be] interpreted in the light of the relevant provisions of the
Chapters against which the reservation is taken. To the extent that:

(a) the Phase-Out element provides for the phasing out of non-conforming aspects of
measures, the Phase-Out element shall prevail over all other elements;
(b) the Measures element is qualified by a liberalisation commitment from the
Description element, the Measures element as so qualified shall prevail over all other
elements; and
(c) the Measures element is not so qualified, the Measure element prevails over other
elements, unless a discrepancy between the Measure element and the other elements
considered in their totality is so substantial and material that it would be unreasonable to
conclude that the Measure element prevails, in which case the other elements prevail to
the extent of that discrepancy. A reservation is interpreted in the light of the relevant
provisions of the Articles against which the reservation is taken.
4. Where a Party maintains a measure that requires that a service provider be a natural person,
citizen, permanent resident or resident of its territory as a condition to the provision of a service
in its territory, a reservation for that measure taken with respect to cross-border services shall
operate as a reservation with respect to investment, to the extent of that measure.
5. For purposes of this Annex:
CPC means Central Product Classification (CPC) numbers as set out in Statistical Office of the
United Nations, Statistical Papers, Series M, No. 77, Provisional Central Product Classification,
1991;
ISIC rev 3.1 means the International Standard Industrial Classification of all Economic Activities
as set out in Statistical Office of the United Nations, Statistical Papers, Series M, N° 4, ISIC
REV 3.1, 2002;
SIC means Standard Industrial Classification (SIC) numbers as set out in Statistics Canada,
Standard Industrial Classification, fourth edition, 1980.

By exception, aircraft registered in Canada may be leased by a
Canadian air carrier to an air carrier of the EU under certain
circumstances - for the air carrier of the GW¯s exceptional needs.
seasonal capacity needs, or needs to overcome operational
difficulties, which cannot reasonably be satisfied through leasing
aircraft registered within the EU, and subject to obtaining the
approval for a limited duration from the Member State of the EU
licensing the air carrier of the EU.
An operating licence may be granted to an air carrier provided that
Member States and/or nationals of Member States, or countries
that have an agreement with the EU allowing for majority
ownership and control on a reciprocal basis, own more than 50%
of the undertaking and effectively control it, except as provided
otherwise in an agreement.
For groundhandling services, establishment within the EU area
may be required. The level of openness of groundhandling services
depends on the size of airport. The number of providers in each
airport may be limited. For "big airports", this limit may not be less
than two suppliers. For greater certainty, this does not affect the
EU's rights and obligations under the Agreement on Air Transport
between Canada and the European Community and its Member
States.
For airport operations, establishment within the EU is required.
Airport operation services may be subject to individual concession
or licence from public authorities. Special approval from the
competent authority may be needed for the holder of the licence or
the concession to transfer the operation licence or concession in
total or in part to a third party.
With respect to computer reservation system (CRS) services,
where EU air carriers are not accorded, by CRS services suppliers
operating outside the EU, equivalent (meaning non-discriminatory)
treatment to that provided in the EU, or where EU CRS services

Goods or passenger transport operations by inland waterway may
only be provided by an operator that fulfils the following
conditions:
- is established in a Member State,
- is entitled there to carry out the (international) transport of
goods or passengers by inland waterway, and
- uses vessels registered in a Member State or in possession of a
certificate of membership of a fleet of a Member State.
In addition, the vessels must be owned by natural persons
domiciled in a Member State and who are Member States
nationals, or owned by legal persons registered in a Member State
and the majority of whom are Member State nationals. Derogations
from the majority ownership requirement may exceptionally be
provided.
In Spain, Sweden and Finland there is no legal distinction between
maritime and internal waterways. The regulation of maritime
transport applies equally to internal waterways.

Services ª Non-Conforming Measures), the reservations taken by that Party with respect to
specific sectors, sub-sectors or activities for which it may maintain existing, or adopt new or
more restrictive, measures that do not conform with obligations imposed by:

3. In interpreting a reservation, all elements of the reservation [are] [shall be] considered. The
Description element [prevails] [shall prevail] over all other elements.
4. A reservation taken at the level of the European Union applies to a measure of any EU
Member State at the national level as well as a measure of a government within a EU Member
State, unless the reservation excludes a EU Member State. A reservation taken at the national
level by Canada or by an EU Member State applies to a measure of a government at regional,
provincial, territorial or local level within that country.
5. Where a Party maintains a measure that requires that a service provider be a natural person,
citizen, permanent resident or resident of its territory, as a condition to the provision of a service
in its territory, a reservation for that measure taken with respect to cross-border services shall be
applied as a reservation with respect to investment, to the extent of that measure.
6. For purposes of this Annex:
CPC means Central Product Classification (CPC) numbers as set out in Statistical Office of the

services, health services, transport services and services auxiliary to

An internal market on services and establishment means an
area without internal frontiers in which the free movement of
services, capital and persons is ensured.
The right of establishment means an obligation to abolish in
substance all barriers to establishment among the parties to the
regional economic integration agreement by the entry into force of
that agreement. The right of establishment shall include the right of
nationals of the parties to the regional economic integration
agreement to set up and operate enterprises under the same
conditions provided for nationals under the domestic law of the
country where such establishment takes place.
The approximation of legislation means:
(i) the alignment of the legislation of one or more of the parties to
the regional economic integration agreement with the legislation of
the other party or parties to that agreement; or
(ii) the incorporation of common legislation into the domestic law
of the parties to the regional economic integration agreement.
Such alignment or incorporation shall take place, and shall be

the jurisdiction of Member States of the EU.
The EU reserves the right to adopt or maintain any measure:
- regulating the landing of catches performed in the sub-quotas
allocated to third country vessels in EU ports;
- determining a minimum size for a company in order to preserve
both artisanal and coastal fishing vessels;
- according differential treatment to a third country pursuant to
existing or future bilateral agreements relating to fisheries.
A commercial fishing licence granting the right to fish in the
territorial waters of an EU Member State may only be granted to
